1. About these Terms
These Terms and Conditions ("Terms") are an agreement between you and Purvue, LLC, doing business as Purvue Health ("Purvue," "we," "us," or "our"). They apply to www.purvuehealth.com, our hosted patient portal, and any related services we offer (together, the "Service").
By creating an account, checking a box to accept these Terms, placing an order, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. Who we are and who provides your care
Purvue is a technology and administrative services company. We are not a medical practice, pharmacy, or laboratory, and we do not practice medicine or provide medical advice.
Medical services offered through the Service are provided by independent, physician-owned medical practices and their licensed clinicians (the "Medical Group" and "Providers"). The Medical Group currently includes Arora Health and Aesthetics HUB, P.A.; Arora Health of CA, PC; Arora Health of NJ, PC; Arora Health of NY, PC; and Arora Health of KS, PC. The practice that treats you depends on the state where you are located.
Your Provider is solely responsible for all medical decisions, including whether to order labs, whether treatment is appropriate for you, and what, if anything, to prescribe. Purvue does not control or interfere with a Provider's clinical judgment. When you receive care through the Service, your provider-patient relationship is with your Provider and the Medical Group, not with Purvue.
Prescriptions are filled and shipped by Vios Compounding Pharmacy, an independent, licensed U.S. pharmacy, and by other licensed pharmacies we may work with (the "Pharmacies"). Lab tests are processed by independent laboratories (the "Labs"). Each is solely responsible for its own professional services.
Purvue supports the Medical Group with non-clinical services such as the website, technology, scheduling, customer support, and billing.
3. Eligibility
To use the Service, you must be at least 18 years old, be physically located in a U.S. state at the time of your visit, and be able to enter into a binding agreement. PURVUE offers treatment services and lab testing in all 50 U.S. states. Individual treatment and testing options depend on clinical review, your location and applicable state requirements. Your Provider must be licensed or otherwise authorized to provide care in the state where you are physically located during your clinical appointment.
You agree to give true, accurate, and complete information about yourself, including your identity, location, health history, and current medications, and to keep it up to date. Your Provider relies on this information to treat you safely. You may only use the Service for yourself.
4. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us right away at support@purvuehealth.com if you believe your account has been accessed without your permission. We may suspend or close accounts that contain false information or that violate these Terms.
5. Telehealth
Care through the Service is delivered by telehealth, which means your Provider evaluates you remotely using online questionnaires, messaging, phone, or live video. Telehealth is not right for every person or condition. Your Provider may decide that you need an in-person visit or that treatment through the Service is not appropriate for you.
Before your first visit you will be asked to review and accept the Medical Group's Telehealth Informed Consent and Notice of Privacy Practices. Some treatments may require a live audio-video visit before a prescription can be issued.
The Service does not replace your primary care provider. Please keep your regular doctor informed about any treatment you receive through the Service.
6. Prescription products
Prescription products are available only if a Provider determines, after an evaluation, that they are appropriate for you and issues a valid prescription. Paying for a visit or starting an order does not guarantee a prescription.
Treatments described on the website include compounded semaglutide and compounded tirzepatide. Availability depends on the clinical service and your location. Compounded medications are prepared by a licensed pharmacy for an individual patient and are not reviewed or approved by the FDA for safety, effectiveness, or quality. Your Provider can answer questions about any medication prescribed to you. We may add or remove treatments over time.
Use medications only as prescribed, read all information that comes with them, store them safely away from children, and contact your Provider through the portal with questions or side effects. If you have a serious reaction, call 911.
If you prefer to use a different pharmacy, ask your Provider. If your prescription is sent to an outside pharmacy, you will pay that pharmacy directly.
7. Lab testing
When lab testing is ordered, a Provider orders the tests and independent Labs perform them. Results are shared with you through the portal and reviewed by a Provider. Lab testing is offered in all 50 U.S. states. Specific tests and collection arrangements depend on clinical review and applicable state requirements; confirm those details before ordering.
8. Pricing and payment
Prices are shown before you complete your purchase and may change over time. Price changes will not affect an order you have already paid for.
The Service is self-pay. We do not accept or bill health insurance, Medicare, Medicaid, or any other government health program, and you agree not to submit claims to those programs for services received through the Service.
Fees for medical services are charged by the Medical Group. Purvue handles billing and collection on the Medical Group's behalf. The price you see may include the Provider's services, medication, lab testing, shipping, and use of the Service.
By providing a payment method, you confirm you are authorized to use it and you authorize charges for your purchases, including any applicable taxes and shipping. Payments are handled by a third-party payment processor. Purvue does not receive or store your full card number.
9. Subscriptions and automatic renewal
Eligible services may be offered as one-time purchases or recurring plans. Memberships, where offered, are recurring. The available purchase options and all material billing terms are shown before you enroll.
A recurring plan requires your express agreement to its price, frequency, renewal terms, and cancellation method. Accepting these Terms alone does not authorize a subscription. The first charge is made at checkout; subsequent charges occur at the disclosed interval before the next applicable order or shipment. Recurring prescriptions require a valid prescription, and your Provider may require follow-up or updated labs.
We provide advance notice of material price or plan changes, apply them to future cycles, and obtain any additional consent required by law. See our Return, Refund and Subscription Policy for complete renewal, cancellation, and refund details.
10. Cancellation
You can cancel future renewals through the patient portal's cancellation option or by emailing support@purvuehealth.com before your next billing date. There is no separate cancellation fee. If you also wish to stop a current order, contact us promptly; whether it can be stopped depends on services already provided and whether pharmacy processing or shipment has begun.
A charge that has already been processed is subject to the Return, Refund and Subscription Policy and applicable law. We confirm cancellations through your account or by email. Canceling a subscription does not automatically erase payment owed for a service already provided or medication already dispensed.
11. Refunds and returns
Prescription medication that has been dispensed or shipped cannot be returned for reuse or resale, and routine returns or exchanges are not available. This does not limit any refund or other remedy required by law or for an incorrect, damaged, or unfulfilled order.
If a Provider does not prescribe or a medication order cannot be fulfilled, medication charges for products that will not be dispensed are refundable. Separately disclosed fees for services already provided may remain payable to the extent permitted by law. Duplicate or incorrect charges and charges after an effective cancellation are also subject to review.
Approved refunds are returned to the original payment method unless another method is required by law or agreed with you. Our Return, Refund and Subscription Policy gives the complete procedure and is part of these Terms.
12. Shipping
Medications are shipped by the Pharmacy to the address you provide, which must be in the same state where you were located for your visit. Delivery dates are estimates. Some medications need refrigeration or other special handling, so please open and store your shipment promptly, following the instructions included.
13. Communications
You agree to receive communications about your account, care, and orders by email, text message, phone, and the patient portal. These service messages are part of using the Service.
We send marketing emails and texts only if you opt in. Consent to marketing texts is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out of texts or HELP for help, and use the unsubscribe link in any marketing email.
Email and text messages are not always secure. Please use the patient portal for anything involving your health.
You agree that we may provide agreements, notices, and records to you electronically, and that these satisfy any requirement that they be in writing.
14. Acceptable use and intellectual property
The Service and its content, including text, graphics, logos, and software, belong to Purvue or its licensors. We give you a limited, personal, non-transferable license to use the Service for its intended purpose.
You agree not to:
- give false information or use another person's identity or account
- obtain medication for anyone other than yourself, or resell or share it
- copy, scrape, reverse engineer, or interfere with the Service or its security
- use the Service for any unlawful purpose
If you send us feedback or suggestions, we may use them without obligation to you.
Website content is for general information only. It is not medical advice and is not a substitute for an evaluation by a licensed clinician.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, PURVUE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY PARTICULAR HEALTH RESULT OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
PURVUE IS NOT RESPONSIBLE FOR THE PROFESSIONAL SERVICES OF THE MEDICAL GROUP, PROVIDERS, PHARMACIES, OR LABS, EACH OF WHICH IS INDEPENDENT AND RESPONSIBLE FOR ITS OWN SERVICES.
16. Limitation of liability and indemnification
TO THE FULLEST EXTENT PERMITTED BY LAW, PURVUE AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID THROUGH THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.
Some states do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits any liability that cannot be limited by law, or any rights you may have against a Provider, Pharmacy, or Lab for their professional services.
You agree to indemnify and hold Purvue harmless from claims and costs arising from your violation of these Terms, your misuse of the Service, or false information you provide.
17. Dispute resolution and arbitration
Talk to us first. If you have a concern, email support@purvuehealth.com. If we cannot resolve it within 60 days of receiving your written description of the dispute, either of us may begin arbitration.
Binding arbitration. Any dispute between you and Purvue relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration may take place by phone, video, or written submissions, or in person in the county where you live. Payment of arbitration fees is governed by the AAA rules. The Federal Arbitration Act applies to this section.
Exceptions. Either of us may bring an individual claim in small claims court, or seek a court order to protect intellectual property.
Class action and jury waiver. YOU AND PURVUE AGREE TO BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS, AND NOT AS PART OF ANY CLASS OR REPRESENTATIVE ACTION. YOU AND PURVUE WAIVE THE RIGHT TO A JURY TRIAL.
Right to opt out. You may opt out of this arbitration agreement by emailing support@purvuehealth.com within 30 days of first accepting these Terms, with your name and a statement that you are opting out.
18. General terms
Governing law. These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs Section 17. This choice of law does not deprive you of mandatory consumer protections available under the law that applies where you live.
Changes. We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and provide notice of material changes before they take effect where required. Changes do not retroactively alter an existing dispute or remove rights already accrued. If a change requires your affirmative agreement under applicable law, continued use alone is not a substitute for that agreement.
Termination. You may stop using the Service at any time. We may suspend or end your access if you violate these Terms or if we stop offering the Service. Sections that by their nature should continue will survive.
Other terms. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms. We may assign these Terms in connection with a merger, sale, or reorganization. The Medical Group, Providers, Pharmacies, and Labs are intended beneficiaries of Sections 15 through 17. These Terms, together with our Privacy Policy and the consents you accept through the Service, are the entire agreement between you and Purvue about the Service.
California residents. You may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
